Clarification from the Ministry of Public Health


توضيح من وزارة الصحة العامة: منظفات المستودعات لا تخضع لتأشيرة الوزارة و منزلية يخضع لمعايير أوروبية استيراد مبيدات الحشرات والقواضم المنزلية يخضع لمعايير أوروبية


صدر عن وزارة الصحة العامة البيان التالي:

"تعقيبا على المعلومات حول تهريب مبيدات زراعية ضارة إلى السوق اللبناني، ما يلي:
  1. ان وزارة الصحة العامة مسؤولة عن تنظيم عملية استيراد مبيدات الحشرات والقواضم المنزلية فقط اما استيراد المبيدات الزراعية فيخضع لصلاحية وزارة الزراعة.
  2. تتم الموافقة على استيراد مبيدات الحشرات والقواضم المنزلية إستنادا إلى إجازة مسبقة تُمنح لصاحب العلاقة على أساس الملف الفني المقدم من قبله والذي يشتمل على جميع المستندات التي تُثبت فعالية المنتج. وفي هذا المجال، على صاحب العلاقة إثبات ان المادة الفعالة معتمدة لدى الاتحاد الاوروبي وواردة على لائحة الوكالة الأوروبية للمواد الكيميائية.
  3. عند وصول الإرسالية تتم دراسة البيان الجمركي من قبل وزارة الصحة العامة ويتم سحب عينات من الإرسالية للتأكد من تطابق المنتج المستورد مع الإجازة وبناء علية يُتخذ القرار المناسب.
  4. للسلع المستوردة ارقام تعريفية لدى الجمارك ومن خلال هذه الارقام يتم تحديد الشروط والموافقات اللازمة لادخالها.
           فالارقام التعريفية لمبيدات الحشرات والقواضم المنزلية هي: 3808.91.10- 3808.91.20 والتي بدورها تشير الى ان هذه السلع تخضع لتأشيرة وزارة الصحة العامة.
           والارقام التعريفية للمبيدات الزراعية هي :3808.92.10 - 3808.92.20 والتي بدورها تشير إلى ان هذه السلع تخضع لتأشيرة وزارة الزراعة.
          اما الارقام التعريفية للسلعة التي اشير اليها انها تُستورد كمنظفات للمستودعات، فإن ارقامها التعريفية هي: 34.02.11.20 -34.02.11.90 (محضرات غسيل ومحضرات تنظيف) وهي لا تخضع لتأشيرة              وزارة الصحة العامة بل يحتاج استيرادها الى شهادة مطابقة تصدر عن معهد البحوث الصناعية، وبالتالي فإن المعاملة الجمركية لا تُقدم أصلا إلى وزارة الصحة العامة).
  1. من المعروف أن احتمالات حصول التهريب قائمة وسيبقى هناك من يحاول التهرب من الإستحصال على الإجازات اللازمة للإستيراد أو من تأدية الرسوم والضرائب المتوجبة، وهنا يقع على عاتق الإدارة الجمركية مكافحة عمليات التهريب والغش التجاري.
  2. ان وزارة الصحة العامة تسعى دائما إلى حماية صحة المواطن وستقوم بكل ما من شأنه رفع مستوى حمايته ضمن صلاحياتها القانونية".
